1 Terms & Conditions “Boost your Club”

1. Scope & Organizer

The initiative “Boost your Club” is organized by PEAQ Nutrition AG, Dreher-Gasse 2, 8008 Zurich, Switzerland.
These Terms & Conditions govern the rights and obligations between PEAQ Nutrition AG and the participating sports clubs.

2. Eligibility

• Participation is open exclusively to sports clubs based in Switzerland or Liechtenstein that are registered in the relevant club register and meet the legal requirements of Art. 60 ff. of the Swiss Civil Code (ZGB).
• A club is only admitted once the registration form on the PEAQ website has been fully, truthfully, and properly completed.
• There is no entitlement to participate. PEAQ Nutrition AG decides at its sole discretion on admission.

3. Program Mechanism

• After successful registration, club members, supporters, and friends of the club may select the respective club when shopping in the PEAQ webshop.
• For every 12-pack of PEAQ sold, an amount of CHF 5.– will be credited to the selected club.
• The accumulated amount constitutes a sponsorship contribution.

4. Payout

• A payout will only be made if at least CHF 100.– has been collected in the name of the club.
• Amounts below this threshold will expire without replacement and will not be carried forward to subsequent years.
• Sponsorship contributions will be paid after the end of the program.
• After being contacted by PEAQ Nutrition AG, the club is obliged to provide the required information (in particular bank details and VAT status) digitally within 30 days.
• Upon receipt of this information, the sponsorship contribution will be transferred within 60 days.
• Payments are made exclusively as sponsorship contributions; there is no entitlement to any other form of compensation.

5. Program Duration

• The program starts on 1 September 2025 and ends on 31 August 2026.
• By 30 September 2026 at the latest, all duly registered clubs will be contacted by PEAQ Nutrition AG.

6. Rights & Obligations

• Clubs undertake to provide only truthful information in the context of the program and not to misuse the program.
• PEAQ Nutrition AG reserves the right to exclude clubs from participation at any time if the eligibility requirements are not met or if these Terms & Conditions are violated.
• In cases of intentional or grossly negligent misrepresentation, clubs shall be liable for any resulting damages.
• There is no entitlement to continued participation or payouts beyond the duration of the program.

7. Liability

• PEAQ Nutrition AG shall only be liable for damages caused intentionally or through gross negligence.
• Liability for slight negligence, loss of profit, or indirect or consequential damages is excluded.
• Liability for technical disruptions (e.g., website outages, transmission errors, system interruptions) is expressly excluded.

8. Data Protection

• Data collected as part of registration and execution will be used exclusively for the “Boost your Club” program.
• Data will only be passed on to third parties where necessary for the execution of the program (e.g., payment processing, IT service providers).
• The Swiss Data Protection Act (DSG) applies. Further details can be found in the PEAQ Privacy Policy.

9. Force Majeure

• PEAQ Nutrition AG accepts no liability and is not obliged to conduct the program if unforeseeable events beyond its control occur (e.g., natural disasters, government orders, war, pandemic, supply or production shortages).
• In such cases, the program may be modified, postponed, or terminated without any entitlement to compensation.

10. Final Provisions

• PEAQ Nutrition AG reserves the right to change or terminate the program or these Terms & Conditions at any time. Already confirmed sponsorship contributions remain unaffected.
• Communications relating to the program will be made exclusively by e-mail to the address provided in the registration form.
• Swiss law shall apply exclusively.
• The place of jurisdiction is the registered office of PEAQ Nutrition AG.
